This Privacy Policy (the “Privacy Policy”) applies to personal information Ace Hardware Corporation and their U.S.-based affiliates (collectively referred to as “Ace Hardware”) collect in connection with applications for employment with Ace Hardware, including those submitted via our websites, or other digital interfaces. This Privacy Policy applies to individuals who are applying for employment with Ace Hardware within the United States. Please note this Privacy Policy does not apply to applicants for employment with Ace Hardware’s retailers. The posting for the job you are applying to will tell you whether it is being offered by Ace Hardware’s or by a retailer. If you apply for employment with a retailer, that retailer uses your personal information pursuant to its own privacy practices. What Type of Information Do We Collect and Process?

We collect the information you provide during the application process, which may include the following:

  • Contact information, such as your name (first, middle, last), home address/country, telephone number and email address, your birth day and month, and your age;
  • Your work experience (e.g., employment history, company, location, highest level of education, major area of study, graduation year, degree, GPA), professional certifications, relevant prior trainings or courses, confirmation of reliable transportation, language capabilities, your area/department/role of interest within Ace Hardware’s, total compensation expectation, work schedule preferences, first possible start date, the fact that you may be subject to a non-compete, applicable termination/notice periods, restrictive covenant or any other agreement that might affect your ability to accept a position and work at Ace Hardware, references, letters of recommendation, interview notes, the source you heard about the job vacancy, and availabilities to schedule an in person interview;
  • Volunteering experience, family members who work at Ace Hardware and the nature of your relationship to them, your eligibility to work in the United States and/or your selected location, and any limitations on your eligibility to work associated with your employment sponsorship, if applicable;
  • Optional demographic information that is not part of your application, e.g. gender, race/ethnicity, veteran status and disability, etc.;
  • Information we need to provide you with an offer (e.g., rate of pay, start date, job title), and;
  • The results of other application-related assessments.

You may have the option to add attachments or further information (e.g., a CV or Resume, a cover letter or message, certifications or skills, language capabilities or a letter of recommendation) which might contain additional personal information. Such attachments and further information will be treated in the same ways as other personal information you provide to us during the application process.

We may collect certain additional information that is not part of your application, such as military and/or veteran status, your ability to perform expected physical requirements of the position for which you are applying, physical limitations or other medical or health-related workplace accommodations, the results of background screening searches including criminal background checks, educational background checks, drug and alcohol testing, and other pre-employment screenings.

Use of Cookies and Other Technologies

Like many online services, we may collect and store certain information automatically whenever you interact with our careers page. For example, we may collect your IP address, browser and device information, including operating system, application software, and reference site domain name, every time you access or use the website. We may also collect information regarding traffic patterns and usage and mobile application usage data. We may use this information in combination with other information we have about you, including personal information.

Ace uses cookies, which are small data files created by a web server and stored by your browser. Ace may use session recording software, in order to better understand our users’ needs and to optimize the careers page and experience.

Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain the careers page with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. Some web browsers may have a “Do Not Track” preference that transmits a “Do Not Track” header to the websites you visit with information indicating that you do not want your activity to be tracked. Ace Hardware does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

How Do We Use Your Information?

We use this information to assess your qualifications for employment and other related services during the application and recruitment stage. This may include contacting you after you have applied, contacting references that you have provided as well as potentially carrying out background checks and drug screens. We may use applicant information for benchmarking, analyzing, and reporting on the diversity of candidate pools, individualized reporting and analytics of statistical information, and informing and developing our recruitment. We may also contact you about any other jobs we think may be of interest to you. We also may use your information to comply with any applicable legal obligations or applicable Ace Hardware policies, record-keeping or reporting obligations as well as to establish, exercise or defend against any legal claims. If you are hired as an employee of Ace Hardware Corporation, we may retain and use your information for employment purposes.

How Do We Disclose and Share Your Information?

In order to carry out the application and recruitment process under this Privacy Policy, your information may be shared with other Ace Hardware employees such as your potential manager(s), members of the human resources team as well as other individuals within Ace Hardware. Your information also may be shared with various third parties that assist us during the recruitment process. For example, we use third party service providers to collect your information as well as for other services such as carrying out background checks, work-related assessments or pre-employment screenings. We may also share information with third parties when we believe in good faith that the disclosure is required to comply with a court order, subpoena, warrant or legal process. We may also share your information in the event of a merger, acquisition, asset sale or other related transaction, or when we believe in good faith that disclosure is required by law or to protect the safety of our employees, the public or Ace Hardware’s property.

For students, we may share information with your university in order to verify your application and/or employment status at your or your university’s request.

Information We Receive from Third Parties

If you chose a third party to submit your application for positions with Ace Hardware or to fill out your application for you, we may receive information about you, which might contain additional personal information. Such information will be treated in the same way as other personal information you provide to us during the application process.

What is Our Data Retention?

Ace Hardware will retain the personal information that we process pursuant to this Privacy Policy for the duration of time necessary to assess your qualifications for employment, and for the period of time thereafter as provided in our retention policies. If you are hired as an employee of Ace Hardware Corporation, we may retain and use your information for employment purposes. You may also elect to have your information remain with Ace Hardware, for example, if you continue to maintain a career profile on one of our websites.

What Steps Are Taken to Keep Personal Information Secure?

What Happens When I Link to or From Another Web Site or Use Social Media Features?

Our websites may offer links to websites that are not run by us but by third parties. We are not responsible for the policies and practices of third parties. CATEGORIES OF PERSONAL INFORMAITON COLLECTED: Generally, we may collect the following categories of personal information (as set forth in the CCPA) about Applicants and Employees:

Name, Contact Info, and other identifiers. Identifiers such as a real name, alias, postal address, unique personal identifier, online identifiers, Internet Protocol address, email address, social security number, driver’s license number, or other similar identifiers.

Protected Classifications. Characteristics of protected classifications under California or federal law such as race, color, sex, disability, gender identity, national origin, and military/veteran status.

Biometric Information.Physiological, biological or behavioral characteristics that can be used alone or in combination with each other to establish individual identity, including exercise data that contains identifying information.

Usage Data. Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a resident’s interaction with an internet website, application, or advertisement, as well as physical and network access logs and other network activity information related to your use of any Company device, network or other information resource.

Audio, Video and other Electronic Data. Audio, electronic, visual, or similar information such as, CCTV footage, photographs, and call recordings and other audio recordings (e.g., recorded meetings and webinars).

Employment History. Professional or employment-related information.

Education Information. Information about education history or background that is not publicly available personally identifiable information as defined in the federal Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99).

Profiles and Inferences. Inferences drawn from any of the information identified above to create a profile about an applicant reflecting the Applicant’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Other Information. Third-party drug screening test results, information required by the U.S. Department of Transportation for commercial drivers, including but not limited to motor vehicle reports, violation and accident history, and drug and alcohol testing results.

PURPOSES FOR COLLECTING AND USING PERSONAL INFORMATION: Generally, we may use the above categories of personal information for the following purposes:

Recruiting, Hiring and Managing, and Evaluating Applicants and Employees. To review, assess, recruit, consider or otherwise manage Applicants and job applications, including:

  • Scheduling and conducting interviews
  • Identifying Applicants, including by working with external recruiters
  • Reviewing, assessing and verifying information provided, to conduct criminal and background checks (where relevant and pursuant to applicable law), conduct pre-employment drug tests, and to otherwise screen or evaluate Applicants’ qualifications, suitability and relevant characteristics
